The High Court of Abia State at Isialangwa Judicial division, has recently ruled on the jurisdiction of the court to entertain the suit filed by 3 claimants in their name and purportedly on behalf of Aba Electricity Consumers Forum. The claimants are Comrades Ike Opiwge, Ojukwu Imo, and Leonard Onyemesiri.

The matter is still at its preliminary stages, and no judgment has so far been delivered by the court. The court in giving a ruling on the Preliminary Objection filled by the Defendants challenging the jurisdiction of the court, as detailed in a certified true copy obtained by *National Concord, examined whether the forum had the legal authority to sue or be sued.

During the proceedings, Aba Power’s legal team questioned whether the unregistered or unincorporated Aba Electricity Consumers Forum had the necessary legal standing to participate in the case. The court determined that such groups must have statutory backing or formal legal recognition to initiate legal action.

In the said ruling, the court determined that the Aba Electricity Consumers Forum did not meet the requirements to be a formal party in the case, citing three key reasons:

  • The forum lacked statutory recognition and was not legally established to sue or be sued.
  • Legal action should be brought by directly affected individuals or properly registered entities, such as those incorporated under the Corporate Affairs Commission (CAC).
  • Consumer groups must follow due legal processes to gain recognition, either through registration or collaboration with regulatory bodies.

This decision has significant implications for consumer advocacy groups who often institute court cases in a representative court and without the consent of the individuals and groups they claim to represent. The court emphasizing the need for such groups to obtain proper legal status to enhance their capacity. It also sets the stage for the matter to proceed on behalf of the 3 claimants only, and not purportedly in behalf of all the electricity consumers in Aba.

Whereas the case was originally filed by Comrades Ike Opiwge, Ojukwu Imo, and Leonard Onyemesiri for themselves and on behalf of the Aba Electricity Consumers Forum, challenging Aba Power’s disconnection of supply to non paying customers citing the purported court order not to disconnect them even without paying their official bills, on February 20, the High Court of Abia State issued an injunction preventing Aba Power from disconnecting consumers.

Justice Enyinnaya Okezie granted an ex-parte motion allowing legal notices to be served on Aba Power, Geometric Power Limited, and the Nigerian Electricity Regulatory Commission (NERC) through substituted means.

Following concerns over customers’ refusal to pay electricity bills, Aba Power released a statement through its Brand and Communications Manager, Edise Ekong, on March 26, reaffirming its commitment to addressing consumer complaints. The company attributed higher bills to increased consumption due to improved power supply and announced plans to expand its free mass metering program, with 50,000 new meters expected between April and May.

Although the court ruled against the forum’s legal standing, it reinforced the importance of consumer representation.

The ruling ultimately reinforces Aba Power’s position in the dispute by affirming that only legally recognized entities or directly affected individuals can file lawsuits. The company continues to prioritize service improvements, consumer engagement, and regulatory compliance, demonstrating its commitment to resolving issues within the framework of due process.
