A Federal High Court sitting in Abuja has ruled that former Nigerian President Goodluck Jonathan remains constitutionally eligible to contest the 2027 presidential election, dismissing a legal challenge that sought to permanently stop his return to the ballot.
The judgment, delivered by Justice Peter Lifu, held that there is no legal barrier preventing Jonathan from seeking the presidency again if he decides to run. The court further ruled that the matter had already been substantially determined in earlier judicial decisions, including rulings by both the Federal High Court in Yenagoa and the Court of Appeal.
The suit was filed by Abuja-based lawyer Johnmary Jideobi, who argued that Jonathan had exhausted the constitutional limit for presidential tenure after completing the remaining term of late President Umaru Musa Yar’Adua in 2010 and later serving a full elected term after winning the 2011 election. The plaintiff asked the court to restrain Jonathan from contesting and prevent the Independent National Electoral Commission from accepting any future nomination bearing his name.
However, the court rejected those arguments and held that the plaintiff lacked the legal standing to institute the action. Justice Lifu described the case as frivolous and an abuse of court process, stressing that lower courts remain bound by existing appellate decisions on the issue. Reports also indicated that financial penalties were imposed against the plaintiff following the dismissal of the case.
Jonathan’s eligibility has remained a recurring constitutional debate because he first assumed office through succession following Yar’Adua’s death before later securing an electoral mandate in 2011. The controversy intensified after constitutional amendments introduced provisions relating to succession and presidential tenure limits, although previous courts held those provisions could not be applied retroactively to Jonathan’s case.
While Jonathan has not officially declared his intention to run in 2027, the ruling is expected to intensify political discussions and strategic calculations ahead of Nigeria’s next presidential election cycle.
