The Independent National Electoral Commission (INEC) has warned political parties that any primary elections conducted after the May 30 deadline set by the commission will be regarded as invalid, pending the resolution of ongoing legal disputes.

INEC’s position comes amid growing uncertainty following conflicting court rulings that have sparked debate over the commission’s authority to determine timelines for party primaries and other electoral activities.

Speaking on the development, INEC National Commissioner, Mohammed Kudu Haruna, stated that the commission remains bound by the provisions of the Electoral Act 2026 and will continue to operate within the framework of existing laws until the Court of Appeal delivers a final decision on the matter.

According to him, political parties are expected to comply fully with the commission’s timetable and electoral guidelines to avoid complications that could affect the eligibility of their candidates in future elections.

Haruna emphasized that the commission has not altered its position regarding the deadline and advised parties to refrain from conducting primary elections outside the approved schedule.

The controversy follows conflicting judgments delivered by different courts concerning INEC’s powers to fix election timetables. The rulings have generated legal and political discussions among stakeholders, with some arguing that political parties should have greater flexibility in managing their internal electoral processes, while others insist that strict adherence to the electoral calendar is necessary to ensure orderly elections.

Election observers note that the outcome of the appeal proceedings could have significant implications for political parties preparing for upcoming elections, particularly those that may have delayed their primary processes due to internal disputes or legal challenges.

Despite the ongoing litigation, INEC has reiterated that its timetable remains in force and that all political actors are expected to comply with existing regulations until a superior court rules otherwise.

The commission’s warning serves as a reminder of the importance of adhering to electoral timelines as preparations continue for future elections across the country.
