The leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu, appeared before Justice Binta Nyako of the Federal High Court on Monday, to resume the hearing of his prolonged trial. Kanu, who has been detained since June 2021, questioned the jurisdiction of the court over his alleged terrorism charges, reigniting debates about the legal proceedings surrounding his case.

Despite Kanu’s insistence that Justice Nyako had no authority to preside over the matter, the judge adjourned the trial indefinitely. “All that the judge said was meaningless to me,” Kanu declared in court, underscoring his refusal to acknowledge the court’s jurisdiction over his case.

Recusal Controversy
The controversy surrounding the case escalated when Justice Nyako recused herself on September 24, 2024, following an oral application by Kanu. The IPOB leader openly expressed his lack of confidence in her handling of the trial. However, Chief Judge John Tsoho later reversed this decision, insisting that Kanu’s application for recusal must be formally submitted through a motion on notice.
In response, prosecution counsel Adegboyega Awomolo, in a letter dated December 5, 2024, urged the court to fix a date for the trial’s commencement. On the other hand, defence counsel Aloy Ejimakor maintained that Justice Nyako’s recusal was valid. “The judge’s decision to recuse herself stands unless formally vacated by a competent judicial order,” Ejimakor argued in a December 9, 2024, letter.
Ejimakor also suggested transferring the case to a Federal High Court in the South-East if no judge in Abuja was willing to preside. However, this request was dismissed.
Resumed Hearing and Legal Arguments
During the resumed hearing, Justice Nyako clarified that the Chief Judge had not accepted her recusal and had referred the case back to her. She instructed the defence to file a formal application if they still insisted on the recusal.

The prosecution, led by Awomolo, expressed readiness to commence the trial, asserting that witnesses were prepared to testify.
Kanu’s Outburst in Court
Kanu’s frustration was evident during the hearing. “Why am I being brought back before this judge?” he questioned passionately. He maintained that he does not recognize Justice Nyako’s authority over him, pointing to what he described as the poor understanding of judicial procedures in Nigeria.
